  • Per Cap Distribution of Funds Held in Trust by Dept. of the Interior

    IRS guidance concerning the federal income tax treatment of per capita distributions made to members of Indian tribes from funds held in trust by the Secretary of the Interior. Comments re notice due Sept. 17, 2014.

     
  • FTB 'Tribal Source' refund process

    Process for submitting a claim for a refund of income tax that was improperly assessed.

     
  • FTB Tribal Consultation re 'live on/off' reservation

    FTB held a Sept. 18th meeting to discuss recommendations re how to determine if tribal member lives on/off reservation. This may be the only public comment session. See FTB recommendation and read a transcript of the meeting.

     
  • Taxing Indian Country: Regulation 1616

    Effective Feb 10, 2012 the California Board of Equalization implemented a law re: Property Used in Tribal Self-Governance. On July 6, 2012 they issued a formal letter for landless tribes to claim exemption from sales/use tax. See Oct. 2012 Notice.
